I MAKE MY LAW AND I BREAK IT MYSELF


Burmese Prime Minister Thein Sein and his government colleagues who formed the Union Solidarity and Development Party (USDP) on Thursday may be in violation of junta election laws stating that persons forming a political party may not hold government positions.

Article 4 of the Political Party Registration Law says that a person who forms a political party must not hold a government position.

State-run radio and television reported on Thursday that the USDP had been organized by 27 government officials, including Prime Minister Thein Sein and Rangoon mayor Aung Thein Lin, and had registered with the Union Election Commission (UEC).

On Monday, Burma's military establishment ordered Thein Sein, Aung Thein Lin and 20 other senior officials to retire from their military positions.

On Friday, however, state-run newspapers still described Thein Sein and the others forming the USDP as government officials, and their were no reports of resignations from government positions by any USDP official.

Aye Lwin, the chairman of the Union of Myanmar Federation of National Politics, one of 25 political parties currently registered and one of 12 currently approved by the UEC, spoke about the apparent violation of the junta's election laws by the junta-backed USDP.

“When we first registered at the election commission, we had to sign a document saying we were not holding a position in government. I think Thein Shein and the other government officials who formed the USDP also had to sign this document,” said Aye Lwin.

“The State Peace and Development Council published the election laws, so the USDP officials would know the laws well at the time they registered. And they would certainly know that the position of prime minister is a government position,” he said.

The junta-backed Union Solidarity and Development Association (USDA), founded in 1993 as a social organization, claims to have a membership of about 24 million, including students, civil servants and military personnel. Although it claims to be apolitical, the USDA has long been actively involved in implementing the ruling regime’s policies.

Thu Wai, the chairman of the Democratic Party (Myanmar), criticized the decision of government officials to form a political party closely linked with the USDA.

“It is not right to use the USDA name. The minister of home affairs once said that the USDA will be a social organization. If it transforms into a political party, all its members have to quit the organization. I intend to discuss this with the election commission.”

Minister of Home Affairs Maj-Gen Maung Oo did, however, signal the regime’s plans for the USDA when he said in 2002 that the organization must be able to play a role in politics alongside other political parties.

Win Tin, one of the leaders of the National League for Democracy, which has announced it will not register for the election, says the decision of Thein Sein and the other generals to form the USDP has altered the political landscape.

He told the Irrawaddy on Friday, “I expected that the army would only take a 25 percent position in parliament, in accordance with the 2008 constitution. But the situation is now different from what I expected. The military-led USDP is going to contest the election, which means they intend to transform the army into a political party.”

Suicide bomber targets Burmese police


A man being interrogated by police in Burma detonated a bomb, killing himself and wounding four officers in eastern Karenni state, residents and officials said Wednesday.

The bomb Tuesday was the latest in a series of explosions to hit the military-ruled nation in recent weeks, as the reclusive junta government prepares to hold the country’s first elections in 20 years.

“A man about 30 years old exploded the bomb and killed himself. Four police beside him were injured during the blast at the police station,” a resident of Loikaw town in Karenni state told AFP, requesting anonymity.

“We do not know how he exploded the bomb,” he said.

An official confirmed the blast and casualties in Loikaw, 400 kilometres (250 miles) from Burma’s economic hub Rangoon.

“He had been taken to the police station for questioning as a suspect. Nobody suspected he would do this,” the official said on condition of anonymity.

It was unclear exactly why he was taken for questioning and if he had intentionally committed suicide.

Also Tuesday, a series of grenade blasts hit a hydropower plant under construction in neighbouring Bago province, run by Burmese company Asia World Construction.

Another of the company’s projects, a controversial dam in Kachin state, was hit by a series of bombs blasts earlier this month, injuring one engineer.

Three other bombs on 15 April hit a water festival in Rangoon, in the city’s worst attack in five years. The official death toll from that attack has now risen to 10 people, with at least 170 wounded.

Authorities have arrested suspects in relation to the Rangoon blasts, officials said, but declined to give further details while investigations were ongoing.

Burma has been hit by several bomb blasts in recent years which the junta has blamed on armed exile groups or ethnic rebels.

The latest attacks come as the country prepares for polls, planned for the end of this year, which critics have dismissed as a sham due to the effective barring of opposition leader Aung San Suu Kyi as she is a serving prisoner.

The military has ruled Burma since 1962, partly justifying its grip on power by the need to fend off ethnic rebellions that have plagued remote border areas for decades.

Armed minorities in Karen and Shan states continue to fight the government along the country’s eastern border, alleging they are subject to neglect and mistreatment.

Myanmar’s decades-old conflicts will continue


OPINION In an annual routine policy review, the European Union extended economic sanctions against the military-ruled Myanmar for another year on April 26, 2010. With the continued political imbroglio in this Southeast Asian nation, the decision was not something unexpected.

The sanctions, which include a travel ban and a freeze of assets of enterprises owned by members of the ruling junta and people associated with them, is aimed at bringing the military leadership to the path of dialogue that would eventually lead Myanmar to democracy.

The European Union wants to see the establishment of a democratically elected civilian government which engages in socio-economic development, and respects human rights while rebuilding relations with the international community.

The European Union renewed its call for the release of Aung San Suu Kyi, the leader of the opposition and general secretary of the National League for Democracy, and also offered to hold dialogue with the junta if it makes a tangible democratic progress.

Given its history of recalcitrance, the military junta is unlikely to give in to the calls of the European Union. Nevertheless, the junta in its own way is seeking recognition, if not endorsement, from the international community.

Two important reasons

With years of criticisms and pressures from the international community, the military leaders plan to legitimize its rule by holding a general election. The goal is to transform the dictatorial-type of regime to a civilian form of government, where the ultimate power rests in the hands of military.

There are two important reasons, among others, that concern the military leadership of losing its power to a civilian government – safety and control.

After decades of brutality on its own people, the military leadership is concerned about their own safety under a democratically elected government. The trial and execution of former military leaders in Iraq is something that probably worries the Myanmar military leaders.

With the different ethnic nationalities demanding political autonomy, the junta is wary of any decentralization of the Myanmar society. Under the present system, the military controls all branches of the government – legislative, executive and judiciary.

It is symbolically significant, at this juncture, to the Myanmar opposition that the European Union has extended sanctions for another year. The move can be construed as support for the democratic movement. However, this initiative will remain to be unyielding as long as there is economic engagement by countries such as China, India, and members of the Association of Southeast Asian Nations.

Myanmar's policy failure

It is not the European Union that is solely responsible for Myanmar’s policy failure. It is the conflicting approaches of engagement and sanctions which make the international community’s strategy ineffective.

Beyond economic sanctions, what the European Union can possibly do is to lobby and convince its international partners, at least the Western countries, not to recognize the result of the election if held under the existing restrictive laws.

It could also strive to formulate a coordinated international strategy to effectively deal with the military junta.

If the European Union, together with its international partners, decides not to recognize the election result, the Myanmar military junta will lack the global legitimacy it pursues.

Regardless of the outcome of general election, Myanmar’s decades-old conflicts will continue as long as suppression of ethnic minorities is unabated, and their fundamental rights are denied.

Four wounded in grenade attack


YANGON, April 27 (AFP) - A series of grenade blasts hit a hydropower project in Myanmar Tuesday, wounding four workers in the latest unrest in the military-ruled country, officials said.

The attacks occurred at the Thaukyegat hydropower plant under construction in Bago Division, about 220 kilometres (137 miles) northeast of the country's main city Yangon, a local official told AFP.

"Four workers were injured during three grenade attacks at the Thaukyegat hydropower project site," the official said, asking not to be named because he was not authorised to speak to the media.

The Myanmar company behind the project, Asia World Construction, was also involved in a controversial dam project in Kachin State where there was a series of bombs blasts earlier this month, injuring one engineer.

Three other bombs on April 15 hit a water festival in Yangon, in the city's worst attack in five years. The death toll from that attack has now risen to 10 people, with at least 170 people wounded.

Myanmar authorities have arrested some suspects in their search for the perpetrators of those blasts, officials said, but they did not give any further detail as the investigation is still underway.

Myanmar ministers to resign from military: government source
YANGON (Reuters) – At least 20 ministers in Myanmar's ruling junta will resign from the military this week to become civilian politicians ahead of this year's election, a government official said on Tuesday.

"So far as I heard, about 20 ministers ... and some deputy ministers will officially give up their military positions effective this week," a government official told Reuters by telephone from the capital, Naypyitaw.

"However, they will remain in their present cabinet positions for some time," added the official, who requested anonymity because he is not authorized to speak to the media.

Among those due to resign from their army posts will be Prime Minister Thein Sein, the official said.

The move means the ministers could potentially take parliamentary seats not included in the 25 percent quota allocated to serving armed forces personnel.

The general election, a date for which has not yet been set, has been widely dismissed as a move by the military to extend its five-decade hold on power by creating a facade of civilian rule.

Under the 2008 constitution passed in a disputed referendum, the armed forces chief will still be the country's most powerful figure and key ministries will remain under military control.

Analysts say the legislature will act only as a rubber stamp for the military's policies and will be dominated by the army and its civilian proxies, with independent lawmakers in the minority and largely powerless.

"It's just part of the military's attempt to secure its grip on state power in the post-election period," a retired senior civil servant said of the resignations from the military. He also requested anonymity.

So far, 19 organizations have requested permission to form political parties to run in the election. Five have been given the go-ahead, most of them believed to be close to the junta.

Only four of the existing 10 parties have applied. The deadline for registration is May 6.

The National League for Democracy (NLD), which won the last election in 1990 by a landslide but was denied the chance to rule, announced last month it would boycott this year's polls.

It complained the election rules were unjust and would exclude most of its top politicians, including detained Nobel Peace Prize winner Aung San Suu Kyi, the charismatic NLD leader who analysts say heavily influenced the decision.

The county's biggest party said it would continue to fight for Myanmar's people, even after its dissolution. Many analysts say the move could backfire, playing into the hands of the generals who have long fought to minimize the NLD's influence.

Senator seeks Burmese perspective on US policy

Oklahoma City (Mizzima) – Burmese activists and community leaders in the United States have urged US Senator Richard Lugar to continue pushing for targeted sanctions on Burma’s military rulers, as they say the junta has failed to respond positively to the Obama administration’s new engagement policy, according to a senatorial aide.

Keith Luse, a senior Foreign Relations Committee assistant to Senator Lugar, told Mizzima that Burmese ethnic leaders at a meeting in the senator’s electorate of Indiana state on Sunday had expressed their view that the US should maintain targeted economic sanctions against the regime.

The meeting was held to obtain feedback from Burmese activists and community leaders on the new US-Burma policy, launched by Democrat US President Barack Obama last September, Mr Luse said.

Senator Lugar, a Republican, is the ranking opposition leader on the committee. Democrat Senator John Kerry is the panel’s chairman.

According to Luse, with the Burmese junta not responding positively to the Obama administration’s engagement efforts, the various Burmese ethnic leaders at the meeting said, “Senator Lugar should continue to support sanctions ‘[more targeted against the junta]. And, the senator and Congress should encourage the Obama administration to press the UNSC to act on Burma being referred to the International Criminal Court,” added Luse, who attended the meeting on behalf of Senator Lugar, referring to the United Nations Security Council.

After more than a decade of imposing financial sanctions and diplomatically isolating the Southeast Asian nation, the US last September announced a policy to seek direct engagement with the Burmese military rulers, while maintaining existing sanctions.

US and Burmese officials then held meetings that included a visit by the US Assistant Secretary of State for East Asian and Pacific Affairs, Dr Kurt Campbell, the highest ranking US official to visit Burma in 14 years.

However, no significant progress was made and the Burmese junta has lately been busy with its election plans, which the US ranks below international standards.

“As you are aware, the Obama administration has embarked on a new Burma policy. Senator Lugar is interested in obtaining feedback from Burmese in Indiana about this new policy approach. Do they agree, or do they have other suggestions?” Luse told Mizzima about the meeting on Sunday.

Fort Wayne, Indiana, is home to about 1,500 Burmese, the largest contingent of Burmese dissidents in the United States. Many were active in student and labour unions and political parties such as the opposition National League for Democracy. They had fled their homeland to escape the oppressive military regime.

Daw Aung San Suu Kyi: Perils of military rule in Thailand


RANGOON (AFP) - Thailand's political crisis shows that a constitution drawn up by the military can never deliver stability, the opposition leader Aung San Suu Kyi said Saturday, according to her party.

Burma's military junta, which has ruled for nearly half a century, produced a new constitution as part of a 'road map to democracy' which includes elections due to be held later this year.

The election plans have been widely criticised and subject to a boycott by Suu Kyi's party, the National League for Democracy (NLD), which would have had to expel its leader if it wanted to take part. NLD spokesman Nyan Win said that in a meeting Saturday with Suu Kyi, she discussed the situation in Thailand, which has been wracked by crises since a 2006 coup ejected Prime Minister Thaksin Shinawatra.

'A new government coming to power under a constitution drawn up by the military will never be stable,' he cited her as saying. 'We do not need to see very far. We just see Thailand,' she said. 'Thaksin was an elected person. The military seized the power from an elected person. The constitution was drawn up by the military,' she said.

'After that, what happened with the first (government)? It was not stable,' she said of the short-lived administration that followed the coup. 'This was a result of the constitution being written by the military.'

Nyan Win said Suu Kyi was not giving an opinion on the rights and wrongs of the conflict in Thailand, where red-shirted campaigners largely loyal to Thaksin are calling for the ouster of Prime Minister Abhisit Vejjajiva.

The Kachin Independence Army (KIA) to join the Border Guard Force (BGF) have raised tensions further. Local sources tell Asia News that people are “waiting to see who will fire the first shot”.
In Myitkyina, residents are in favour “of the KIO, the Kachin Independence Organisation”, but the latter “lacks a strong structure” to “face the Burmese military junta.”
A number of bombs exploded in rapid succession at the Asia World company office in Long Ga Zuap village, 10 kilometres south of the construction site. More bombs went off in neighboring villages. According to unconfirmed reports, seven people, all Chinese, were killed in the attacks.
Local sources complain that the project has caused “the destruction of a grotto with the statue of the Virgin Mary.” Kachin state has a large Christian community and many locals were “quite devoted to the holy image” because The military junta has blamed the KIO for the attacks. The military government has set a deadline of April 28 for the armed groups to merge or disarm as the junta tightens its grip on the country ahead of this year's nationwide election.
The Mon cease-fire group, the New Mon State Party (NMSP), declares at a press conference on Friday evening that the party has rejected both the junta's border guard force (BGF) and militia proposals.
“If the Burmese army uses force, we will have to defend ourselves, we will maintain the cease-fire and we will be open to discussions about transforming our troops at some time in the future when there is a democratic government, elected by the people,” Naing Chan Moon said.
Tension has increased between the NMSP and the Burmese military since the Mon rejected the regime's order to transform its army into a BGF last year.
In March, the NMSP moved some of its administration and a stockpile of weapons to a new undisclosed base, a source close to the group said.
The junta knows that with the UWSA involved, any conflict with the ethnic groups could potentially involve a lengthy and bloody campaign. A couple of days before the deadline, the UWSA sent a letter to the junta saying it rejects the BGF proposal.
Groups such as the UWSA, the Kachin Independence Organization (KIO), the Kokang army (officially called the Myanmar National Democratic Alliance Army), the Mongla-based National Democratic Alliance Army and the Shan State Army-North, have formed alliances with each other.
Analysts have said the BGF issue is posing an actual dilemma for the Burmese army as the generals’ proposal has failed to bear fruit.
In Rangoon, residents are collecting and saving rice packages and cooking oil, salt for daily male if the war breaks out.
Burma’s regime, run by ethnic Burmese who make up the majority, is well known for repressing its own people. Considered among the world's most brutal, the regime brooks no dissent and has been accused of large-scale violations of human rights, including the years-long detention of Nobel Peace laureate and democracy icon, Aung San Suu Kyi.

IT IS TIME TO FIGHT FOR FREEDOM IN BURMA


WASHINGTON — US Congressman Dana Rohrabacher has urged “patriots” in the Burmese military to join pro-democracy advocates like Aung San Suu Kyi and ethnic fighters to overthrow the military junta and restore democracy in Burma.

Speaking on the floor of the House of Representative, the California congressman said that patriots and freedom-loving people of Burma will either join against tyranny and foreign domination, or their country will be lost for generations to come.
“The time has come to choose,” Rohrabacher said. “ Let the Burmese, the ethnic people of Burma, the business and military leaders who long for a legitimate and honest government, and all of the other patriots there, let them have the courage to step forward and join together and retake their country. The time is now.”

Rohrabacher said there needs to be reconciliation between the Burmans and the ethnic groups who make up half of Burma's population, adding that in the decades-old insurgency the ethnic fighters have been the primary source of opposition to Burma’s iron-fisted dictatorship.

“Urban democratic leaders like Aung San Suu Kyi and other patriotic Burmans have been beaten down and repressed and imprisoned. These two elements must come together, the Burmans and the ethnic groups that are fighting the Burmese dictatorship,” Rohrabacher said. “They must come together as one under a banner promising respect for the rights and traditions of various people, those various people who make up the wonderfully diverse nation of Burma.”

Rohrabacher appealed for members of the Burmese military to join the fight against the junta.

“An opposition coalition must be joined also by patriots in the military, professional soldiers who seek to remake their army into a respected defender of the nation, not a tool of corruption and foreign domination. It is time for leaders in the army to join the people and build a new, prosperous and free and, yes, independent Burma,” Rohrabacher said.

“In the blink of an eye, Burma can reclaim its sovereignty and can be put on the path to national reconciliation, democracy, and, yes, prosperity. The military in a new Burma, as are professional armies throughout the democratic nations of the world, will be a respected institution, not a tool of foreign domination, repression and corruption,” he said.

Drawing attention to the history of the plight of the people of Burma, Rohrabacher recounted how shortly after World War II Burma was granted its independence from Great Britain. At that time, with democratic institutions in place, rich natural resources and an educated population, it was expected that Burma would become a wealthy, stable and free country.

“Sadly, that country, with so much potential, has been dominated by corrupt tyrants. And despite its vast natural wealth, its people suffer in abject poverty,” Rohrabacher said.

He said the people of Burma are actually losing their country to a foreign power—China.

“A Chinese power grab is not only depleting and stealing Burma’s natural resources, but slowly and surely, Burma is being turned into a subservient province of Beijing,” Rohrabacher said. “China is literally stealing Burma from its own people, and it is accomplishing this monumental crime with the assistance of Burmese government officials whose lust for power is greater than any loyalty to their own national homeland.”

“This is a great moment of opportunity,” Rohrabacher said. “People of Burma, do not let this moment pass by. The world will celebrate with you as you recapture your nation. We are on your side.”

A senior official said the explosions occurred while officials from the Rangoon Great Thingyan Disciplinary Committee were conducting a check of pavilions amid reports that the junta leader's grandson would visit, but “Nay Shwe Thway Aung attended the festival at his own pavilion in front of the RDC compound on Kabar Aye Pagoda Road.

But “ 20 minutes before exploded, Nay Pyi Daw called Nay Shwe Thawy Aung where he was”, said unnamed officer from Myanmar Telecommunication Department.
Meanwhile, 20 people remain in intensive care at Rangoon General Hospital, and 86 men and 29 women are listed in serious condition. Eight people died in the blasts, according to a state-run newspaper.
State newspaper Wednesday charged some anti-government organizations at home and abroad with masterminding a recent terrorist bomb attacks in the water festival in Yangon, in which eight people were killed and 170 others were injured.
Without furnishing firm evidences so far, the "Mirror" accused such organizations as Kayin National Union (KNU), All Burma Students Democratic Front (ABSDF), Kayin Youth Organization (KYO), Democratic Alliance of Burma (DAB), National League for Democracy- Liberated Area (NLD-LA), National Council of the Union of Burma ( NCUB) of being responsible for the bomb attacks, citing some information that these organizations held meetings in a neighboring country earlier to plot bombings during the water festival which targeted at Bago, Mandalay, Yangon and Nay Pyi Taw areas.
Under the name of "A researcher", the commentary of the paper also charged the NLD, one of the 10 old political parties in Myanmar which has boycotted the coming general election, with being involved in the incident along with its allies.
The paper quoted statistics as saying that there occurred 36 cases of such bomb attacks during 2009 and over 300 since 1988 when the present government took power.
The paper further disclosed in a compiled report that during the period of Myanmar's water festival over the past week, bombs blast in four places in the country with the first on April 14 at a toll gate in Muse check point in Shan state run by a private Asia World Company, the second on the same day at the compound of a check point in southeastern Kayin state's Kawkareik, injuring three persons, the third on April 15 at a water throwing pandal in Yangon killing eight people and injuring 170, and the fourth on April 17 at four worksites of the Myitsone hydropower dam project in the upper reaches of the Ayeyawaddy River in northernmost Kachin state on April 17, injuring one person and destroying two temporary buildings and six motor vehicles.
Surprisingly, the Myanmar controlled newspapers did not express the conflict in Nay Pyi Daw since 2010 Electoral Law announced. In Naw Pyi Daw, junta chief Sr-Gen Than Shwe told Gen Thiha Thura Tin Aung Myint Oo to be ready to transfer for political party in 2010 election. But Gen Thiha Thura Tin Aung Myint Oo never showed his wish to bow his head for the junta chief’ s command. But junta prime minister Gen Thein Sein did.

BOMB BLAST IN WATER FESTIVAL IN CAPITAL


Nine people were killed and many wounded in three explosions at a new year water festival in the former Myanmar capital Yangon on Thursday, hospital sources said.

The government has not blamed any group or indicated the cause of the explosions. There were no immediate claims of responsibility.

The junta has in the past blamed bombings on anti-government dissident groups and separate ethnic rebels seeking autonomy in the former Burma, which has been under military rule since 1962.

Witnesses said they heard three loud explosions at a pavilion alongside Kandawgyi Lake. Hospital sources said nine people had died.

"Some people were wounded but we are not in a position to give you further detailed information since necessary investigations are still in progress," police said.

Most of the pavilions on U Htaungbo Road, along the scenic lakeside, are run by companies close to the authorities.

In May 2005 three bombs exploded at a convention center and supermarkets, killing 11 people and wounding over 162. There have been a few sporadic bombings since.

At the time, the authorities blamed ethnic rebel groups, including the Karen National Union, the Shan State Army-South, and the Karenni National Progressive Party, as well as a government in exile known as the National Coalition Government of the Union of Burma, which opposed the junta's rule.

In 1990, Nobel Peace Prize laureate Aung San Suu Kyi's party won a general election but was not allowed to take power by the military, which continues to maintain a tight grip on the country.

An election is expected to be held later in the year but no timeframe has been specified. The upcoming poll has been widely derided in advance as a sham to make the country appear democratic, with the military retaining control over key institutions.

Suu Kyi, who is currently under house arrest, has been in detention without trial for more than 15 of the past 21 years.

Sound of the underground******************************


When the junta banned traditional protest songs, its leading exponents chose a life of exile rather than fall silent. Andrew Buncombe meets them in Delhi..........
First comes the sound of hand drums, followed by a voice that is steady and persistent. As Ngwe Toe leans back and angles his words towards the microphone, his lines are met by a chanting group which takes up his theme and sings back at him, as a call and response.


"The religion in our country," sings Toe, as the group answers for him, "is Theravada Buddhism". The activist continues: "The colour saffron is growing everywhere."

The group responds: "The monks are very graceful, but now their power has been drained. They are hiding in the remote areas."

As the drums continue in a dreamy loop, Toe implores: "Tell me why." The chanters tell him: "The military devil is rising up."

This is a traditional Burmese protest song with a modern twist. For generations, the people of Burma marked their new year by performing Thangyat – songs and skits that gave voice to local grievances.

In 1988, the year in which the military authorities violently crushed a series of democracy demonstrations with the death of at least 3,000 people, the junta decided it had endured enough protest and banned the tradition, threatening jail for anyone who dared to disobey.

But the generals could not stop Thangyat, merely drive it overseas. Now, communities of exiled Burmese around the world put together their own collections of protest songs, which are sold on CDs and even broadcast back into Burma where residents listen secretly on their radios.

One of the most famous and popular groups, of which Ngwe Toe is a member, is based in the west of Delhi. Ahead of the traditional four-day new year celebrations, or water festival, which begins today, the activists recorded and released a new collection of songs, music and poetry entitled Gaining Victory for Us and Defeat for Them.

"During the festival, it is a tradition that if there is something the people do not like, it will be criticised – be it politics, social affairs or food," said Zin Naing, who escaped to India from Burma after the 1988 uprising and who helped produce the recording.

"Now, inside Burma, Thangyat is not allowed, so ours has become one of the only ones that people can get. We produce it on CD as well as cassettes, which are smuggled into Burma."

There are an estimated 6,000 Burmese exiles in Delhi, most of them from Chin state, on India's north-eastern border. Many of them took part in the 1988 uprisings and came to India, which at the time was critical of the military authorities and welcomed the refugees. Most have never dared to even visit their home country since.

Ngwe Toe, the 40-year-old lead singer, fled when he was just 19, leaving behind all his relatives. His father died in 2003, but he dreams of returning to the country with his wife and young son, and of being able to show his child to his mother.

In the meantime, he takes some measure of comfort from imagining his family furtively listening to the songs of protest that he and his friends have recorded. "It's like a rap," he said. "I say the first line and then the others respond with the second. It's a call and response, and when I am singing, I am shouting these slogans with emotion. I am very focused on the song. I would be happy if my mother hears it, and would then be able to give the message that her son is involved in the politics."

The lyrics for the song performed by Ngwe Toe were written by a Buddhist monk, forced to escape to India after taking part in the so-called Saffron Revolution of September 2007, when tens of thousands of monks and citizens took to the streets of Rangoon and other major cities, demanding democratic reforms.

The monk, U Dhamma, a smiling, round-faced 23-year-old, fled after he and several other monks from his monastery joined the demonstrations in the northern city of Mandalay. "I took part in the marches. I thought there would be a revolution. I believed in democratic rule for Burma," said the monk, who crossed into north-eastern India in January 2008 and now lives in the same dusty Delhi neighbourhood as many other exiles. "After the marches, I stayed at the monastery for some months, but then a minister came to give food. We were very angry and refused to accept this. The minister put pressure on the abbot to expel us, and the next day our names were put in the newspaper, saying that we were to be expelled. We had no chance to stay in Burma."

Those who wrote the collection of protest songs have had no shortage of material to inspire them over the past 12 months. Last year, the junta extended the house arrest of opposition leader Aung San Suu Kyi for 18 months, after she was convicted of breaching the terms of her detention when an uninvited US tourist swam to her lakeside home.

Then, last month, the regime announced new rules governing the controversial election due to be held later this year. The rules effectively bar Ms Suu Kyi from standing and say that her party, the National League for Democracy, (NLD), would have to oust her if it wished to field candidates. The NLD has announced it is boycotting the election.

It is not just the junta that comes in for criticism in the Thangyat. While the songs indeed condemn the regime's alleged nuclear ambitions, the election and the country's poverty, the NLD and even politicians in exile are also subjects of satire.

Such humour has long been a tradition of subtle dissent in Burma. One of the country's best-known comics, Zarganar, spent many years making barbed puns about the regime. Eventually, in 2008, the junta ran out of patience with him and seized on an interview he had given to the BBC criticising the authorities' response of the aftermath of Cyclone Nargis. He was jailed for 59 years, a sentence reduced to 35 on appeal.

Likewise, in Mandalay, members of a famous comic troupe known as the Moustache Brothers have been in and out of jail as a result of their performances making fun of the junta.

The Burmese exiles who put together the protest album remain confident that change can come. The song performed by Ngwe Toe says the monks will lead the transformation.

Its last lines, sung as call-and-response, conclude: "If the monks unite – the military becomes afraid. If the monks unite – the religion will be glowing. If the monks take to the front lines – we will escape from poverty. If the monks speak the truth – they will speak to the whole world."

NLD protests rejection of lawsuit against Than Shwe


The National League for Democracy (NLD) has despatched a protest note to the Chief Judge in the Central Court, which states rejection of the lawsuit against Senior General Than Shwe is unlawful, Nyan Win, one of the lawyers of Aung San Suu Kyi, said today.

In keeping with the decision of the Central Executive Committee’s meeting on March 22, signed by Chairman Aung Shwe, NLD filed the lawsuit against Senior General Than Shwe on March 23. However, an authorized person in the Rangoon Division Court rejected the lawsuit. He said that the court does not have the power to accept the case, and returned the documents to the party.

NLD sent the letter because rejection of the lawsuit according to sections 5(a) (h), (j) of 2000 Burma Judiciary Law and sections 45 and 54 of 1887 Specific Relief Act is not in accordance with the law.

“The court rejected the lawsuit which is against the law, so we sent the letter to the Chief Judge by post,” NLD Central Executive Committee’s member, lawyer Nyan Win said.

“The court does not have the right to reject the lawsuit. They should have formally recorded the reason for rejection. Rejecting the lawsuit without a formal record was unlawful,” he added.

According to Nyan Win, when he met Aung San Suu Kyi yesterday, she pointed out that rejecting the lawsuit was unlawful and directed them to continue to take legal action.

ၿပီးခဲ့သည့္ မတ္လအတြင္း တ႐ုတ္ျပည္ဘက္မွ တင္သြင္းလာသည့္ စစ္ကားမ်ားေပၚတြင္ တရားမဝင္ တင္ေဆာင္လာသည့္ တ႐ုတ္ႏိုင္ငံလုပ္ ကုန္ပစၥည္းမ်ားကို စစ္ေဆးေတြ႔ရိွသျဖင့္ ရွမ္းျပည္ေျမာက္ပိုင္း၊ လား႐ိႈးၿမိဳ႕အေျခစိုက္ တပ္ထိန္းအဖဲြ႔က သိမ္းဆည္းခဲ့သည္။

တ႐ုတ္-ျမန္မာ နယ္စပ္ကုန္သြယ္ေရးအား ပံုမွန္ကုန္သြယ္ေရးျဖစ္ေစရန္ ေဆာင္ရြက္ေနခ်ိန္တြင္ လာဘ္ေပး၊ လာဘ္ယူမႈအား ႏိွမ္နင္းၿပီး ေမွာင္ခိုကုန္သြယ္မႈကို တိုက္ဖ်က္သြားေရးအတြက္ နအဖက ေႂကြးေၾကာ္ေနေသာ္လည္း ေမွာင္ခိုကုန္သြယ္မႈမွာ ယေန႔အခ်ိန္အထိ ဆက္လက္ရိွေနဆဲျဖစ္သည္။

'Flag Will Keep Flying'


Leaders of Burma's main opposition party, the National League for Democracy (NLD), have decided not to remove the party signs and insignia from outside the party's headquarters in Rangoon after the deadline for party registration, according to party sources.

One source said the decision is in line with Suu Kyi's view that the NLD will not cease to exist even if it is officially dissolved by the military junta for refusing to register as a political party, the deadline for which is May 7.

“However, the party leaders would not try to prevent the authorities from removing the party signs,” the source said.

After the May 7 deadline for party registration, the NLD headquarters and hundreds of its branch offices across the country, which were only allowed to be reopened last month, are expected to be closed down.

"Why should we remove the party sign? We don't assume that our party is finished just because we didn't register it,” said outspoken party official Win Tin.

The party leadership is currently faced with the dilemma of what the party will do after May 7. Speaking to The Irrawaddy, Suu Kyi's lawyer Nyan Win, who met with the detained NLD leader on Wednesday, said, “All we can say for now is we will continue in politics. Daw Aung San Suu Kyi has many ideas on what to do next. But it is unfortunate that she is still under house arrest.”

At Wednesday's meeting, Suu Kyi expressed her satisfaction at the party's decision on March 29 not to register and contest the polls this year, Nyan Win said.

“The party will be no more, but Daw Aung San Suu Kyi, Vice-chairman Tin Oo and party leader Win Tin will continue the democratic movement,” Nyan Win said, adding that the party does not wish to give false hope to the Burmese people by contesting the election.

As part of its preparations for the party's future after May 7, the party's central executive committee formed a 17-member committee this week to oversee the party's property and finances.

While some observers view the party decision as “suicide” or a self-defeating response, recent surveys conducted by The Irrawaddy suggest that many people in Burma welcomed the party decision, saying the party would no longer be a respectable organization if it decided to register under the regime's “unjust” election laws. The election laws effectively bar Suu Kyi and more than 2,000 political prisoners from this year's polls or from being members of a party.

On Wednesday, the United Nationalities Alliance (UNA), a coalition of 12 ethnic parties which contested and won 67 seats in the 1990 election, issued a statement in support of the NLD decision. Prior to the NLD decision, ethnic leaders representing the UNA made it clear that they will not contest the polls without a review of the regime's 2008 Constitution.

Neither the NLD party or its leader Suu Kyi, currently serving an 18-month house arrest sentence, have ever succeeded in any legal procedure against the regime.

But Suu Kyi's lawyers said that she asked them on Wednesday to continue pursuing legal proceedings on three cases: her continued detention; the lawsuit against regime leader Snr-Gen Than Shwe for setting unjust election laws; and for repairs at her Inya Lake house, which were halted by the Rangoon municipality after Suu Kyi's estranged brother and a distant relative launched objections.

Burma's supreme court in February rejected Suu Kyi's appeal against her current detention, and refused last month to accept a lawsuit against Than Shwe, saying it has no power to consider the case.

The Burmese regime has not set a date for the polls this year. Than Shwe described the election as “the very beginning of the process of fostering democracy,” in his speech on Armed Forces Day in Naypyidaw last month.

ေကာ္မရွင္ ဥကၠ႒ကို ဥေရာပသမဂၢ နာမည္ပ်က္စာရင္းသြင္း Chairman of Burma’s Election Commission on EU blacklist


Deputy Supreme Court Judge Thein Soe, the newly appointed Chairman of Burma's Election Commission is on the EU’s blacklist of sanctions. The list, which targets key members of Burma’s military regime also includes Dr. Tin Aung Aye, a fellow Supreme Court Judge, and also a member of the EC.

Judges Thein Soe, Dr. Tin Aung Aye and other members on the blacklist including notorious junta crony Tay Zaw, are banned from traveling to the European Union. They are also subject to a freeze on any financial assets they may have in Europe. As such they cannot undertake financial transactions with European based financial institutions.

The two judges and other senior members of the Burmese regime’s judiciary were added to the EU's sanctions list following the outcome of Aung San Suu Kyi's August 2009 trial in which she was convicted of flouting the terms of her house arrest after an uninvited American man swam to her home.

According to the EU Council, members of the Burmese judiciary were targeted because of the “gravity of the violation of the fundamental rights of Aung San Suu Kyi. The Council considers it appropriate to include the members of the judiciary responsible for the verdict in the list of persons and entities subject to a travel ban and to an asset freeze".

Before becoming a judge Thein Soe was in Burma's armed forces as a Major General and was a military Judge Advocate General. In 2003 he was appointed to Burma's National Convention led by former Prime Minister Khin Nyunt. In October 2007 Dr. Tin Aung Aye was appointed to the commission for drafting the State Constitution. According to the regime’s state constitution committee announcement, Dr. Tin Aung Aye received both his master’s and doctorate of law in Germany.
